On March 24, 2026, the Department issued a renewal and modification of State Pollutant Discharge Elimination System (SPDES) Permit No. NY0027561 with a five year term effective date May 1, 2026, expiration date April 30, 2031. A Notice of Complete Application was published in the Environmental Notice Bulletin on February 14, 2024. In response to the decision to issue the permit, City of Cortland submitted a timely hearing request dated April 15, 2026, required by 6 NYCRR 624.2(b) and 750-1.26(c) and (d), for an adjudicatory proceeding to contest several permit requirements pertaining to nitrite, phosphorous, and total residual chlorine (TRC) in the LeRoy Summerson Waste Water Treatment Facility's (WWTF’s) new SPDES permit.
A public comment hearing on the challenge of the permit conditions will be held before Administrative Law Judge (ALJ) David N. Greenwood to receive unsworn statements from the public at 10:00 a.m. on Tuesday September 22, 2026. The public comment hearing will be held at the LeRoy R. Summerson WWTF, 251 Port Watson St. Cortland, NY 13045
